Bankruptcy - Chapter 7 vs Chapter 13?
What is the difference between Chapter 7 and Chapter 13? My ex has about $25K in credit card bill she can no longer pay due to job loss. She has talked with a credit agency but simply can't afford the monthly payments.
Ch 7 liquidates all non-exempt assets to repay creditors and discharges the remainder.
Ch 13 repays creditors (either in part or in full, depending on the confirmed plan) from future earnings rather than by liquidating assets.
