I'm currently goin through the Foreclosure process and I've just retained a lawyer to try and reinstate the loan...has anyone out there ever gone through this before? anything you can share? Really scared i may not have enough to re-instate the loan...I
The bank may let you pay a certain amount, and then add the rest of what you owe to the loan. I have seen this done before. Some banks will, others want all back payments paid in full.
You do have options, and your lawyer should be able to explain

My husband is in the process of having the home we live in be foreclosed on. Lendor denied us for another loan modification, we can no longer afford the payments. They only said if finances change, to let them know.
So where can we go seek advice

The Jefferson County Housing Task Force is working with ClearPoint Credit Counseling Solutions and other agencies to bring a wealth of information to homeowners who are in danger of missing a mortgage payment or who are seeking ways to improve their financial situation.
The task force has scheduled a Foreclosure Prevention Fair from 10 a.m. to 4 p.m. Oct. 8 at the High Ridge Fire Department , 2842 High Ridge Blvd., High Ridge.
No registration is required for the event, which also will feature representatives from the Department of Housing and Urban Development, Beyond Housing and the United Way.

This is basically your only defense against the lender. If the court sides with your lender, than a judgment will be placed, a writ will be given and the lender will be allowed to sell your property through a sheriff’s sale. You could be liable for costs even after your property is auctioned off. There is a chance that your lender will force you to pay the difference between the sale and the loan balance at the time of the sale. If you can’t make the payment, you may have to file for bankruptcy. In a non judicial foreclosure, the process is handled with the state statutes. Each state has laid out the process of how a lender can deal with a home in foreclosure. You will have to check with your state laws to know what applies to you. In this case, a default letter will be sent to you from the lender asking you for the missed payments. If you don’t become current with the mortgage, your lender can file a notice of default with the county recorder’s office. Sometimes these letters may be issued at the same time. Once this is processed, a notice of sale will be sent out, however it is important that you understand that each state varies with the foreclosure laws such that some states will send out a notice of sale first and vice versa. This is why it is so crucial that you obtain a foreclosure defense lawyer to walk you through the process and fight for your home.
